column_width_pixel=\u00a0\u00bb800&Prime;][vc_column_text uncode_shortcode_id=\u00a0\u00bb372606&Prime;]<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 1 : Champ d&rsquo;application<\/span><\/h3>\n<p>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente r\u00e9gissent les relations contractuelles pour tout achat de produits effectu\u00e9 sur le site <a href=\"https:\/\/www.aemarielle.com\/\">https:\/\/www.creaturesdolls.com<\/a>, entre toute personne (physique ou morale ci-apr\u00e8s \u00ab le Client \u00bb) ayant pass\u00e9 commande via ledit site, et :<\/p>\n<p>Marie Poisson., domicili\u00e9e au 7 rue de la poste, 85190 Beaulieu sous la roche, France,<\/p>\n<p>N\u00b0 siret 492 555 206 000 27<\/p>\n<p>contact : mewiefish(at)gmail.com<\/p>\n<p>Ci-apr\u00e8s d\u00e9nomm\u00e9e \u00ab l&rsquo;artiste \u00bb,<\/p>\n<p>La passation d&rsquo;une commande sur le Site www.creaturesdolls.com implique sans r\u00e9serve l&rsquo;acceptation des pr\u00e9sentes conditions.<\/p>\n<p>Le Client reconna\u00eet qu\u2019en cochant la mention \u00ab j\u2019ai lu et j\u2019accepte les conditions g\u00e9n\u00e9rales de vente \u00bb, il accepte les pr\u00e9sentes conditions g\u00e9n\u00e9rales de vente.<\/p>\n<p>En cons\u00e9quence, le fait de passer commande implique l\u2019adh\u00e9sion enti\u00e8re et sans r\u00e9serve du Client \u00e0 ces conditions g\u00e9n\u00e9rales de vente.<\/p>\n<p>&nbsp;<\/p>\n<p>Le Client d\u00e9clare :<\/p>\n<ul>\n<li>\u00eatre \u00e2g\u00e9 d&rsquo;au moins 18 ans et avoir la capacit\u00e9 juridique ou \u00eatre titulaire d&rsquo;une autorisation parentale lui permettant d&rsquo;effectuer une commande sur le Site, c\u2019est-\u00e0-dire avoir la majorit\u00e9 l\u00e9gale, ne pas \u00eatre sous tutelle ou curatelle et \u00eatre solvable ;<\/li>\n<li>d\u00e9clare que l\u2019acquisition de ces produits est sans rapport direct avec son activit\u00e9 professionnelle, leur acquisition \u00e9tant r\u00e9serv\u00e9e \u00e0 une utilisation personnelle de sa part.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>L\u2019Artiste se r\u00e9serve la facult\u00e9 de modifier ses CGV \u00e0 tout moment.<\/p>\n<p>En cas de modification des CGV, les CGV applicables sont celles en vigueur \u00e0 la date de la commande dont une copie dat\u00e9e \u00e0 ce jour peut \u00eatre remise, \u00e0 sa demande, au Client.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 2 : Produits et services<\/span><\/h3>\n<p>Les produits vendus sur le site sont originaux, sauf mention sp\u00e9cifique (poster, tirage d\u2019art) indiqu\u00e9e dans la fiche descriptive.<\/p>\n<p>Ils sont pr\u00e9sent\u00e9s dans la page \u00ab boutique \u00bb ou \u00ab shop \u00bb du site avec \u00e0 minima une photographie et un descriptif d\u00e9taill\u00e9 permettant au Client de conna\u00eetre leurs caract\u00e9ristiques essentielles et leur prix. Chaque commande fait l\u2019objet d\u2019un suivi particulier par l\u2019Artiste. Les produits propos\u00e9s \u00e0 la vente par l&rsquo;artiste sont ceux figurant sur le Site au jour de la consultation du Site par le Client. En cas d&rsquo;erreur sur la disponibilit\u00e9 d&rsquo;un produit command\u00e9, l&rsquo;artiste informera rapidement le client par e-mail.<\/p>\n<p>Un certificat d\u2019authenticit\u00e9 \u00e9tabli par l\u2019Artiste sera remis \u00e0 l\u2019acheteur d\u2019une \u0153uvre originale.<\/p>\n<p>Les produits propos\u00e9s \u00e0 la vente sont d\u00e9crits et pr\u00e9sent\u00e9s avec la plus grande exactitude possible. En cas d&rsquo;erreur ou d&rsquo;omission dans cette pr\u00e9sentation, la responsabilit\u00e9 de l&rsquo;artiste ne pourrait \u00eatre engag\u00e9e. Le client peut \u00e0 tout moment poser des questions sur les dits produits\/oeuvres \u00e0 l&rsquo;artiste en passant par la page Contact du site.<\/p>\n<p>L\u2019artiste attire l\u2019attention du client potentiel sur le fait que les photographies des produits visibles sur son site internet ne sont pas contractuelles : elles peuvent parfois s\u2019av\u00e9rer l\u00e9g\u00e8rement diff\u00e9rentes de la r\u00e9alit\u00e9, en raison de nombreux param\u00e8tres techniques tels que la qualit\u00e9 de la carte graphique de l\u2019ordinateur du client, la qualit\u00e9 et les r\u00e9glages de son \u00e9cran et l\u2019\u00e9clairage des produits lors des prises de vue.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 3 : Commande<\/span><\/h3>\n<p>Pour commander un ou plusieurs des produits ou \u0153uvres pr\u00e9sent\u00e9s dans la page boutique de ce Site, le client doit mettre la ou les produits\/\u0153uvres dans son panier puis compl\u00e9ter les informations n\u00e9cessaires \u00e0 son ex\u00e9cution.<\/p>\n<p>Le client peut consulter son panier a\u0300 tout moment tout au long de sa connexion tant que la commande n\u2019est pas d\u00e9finitivement valid\u00e9e et peut corriger \u00e9ventuellement les informations saisies. Ce r\u00e9capitulatif n&rsquo;inclut pas les frais de livraison qui seront calcul\u00e9s en fonction des caract\u00e9ristiques du produit\/l\u2019\u0153uvre et de l\u2019adresse de livraison et demand\u00e9 ult\u00e9rieurement. Une fois sa commande valid\u00e9e, le client re\u00e7oit par email un accuse\u0301 r\u00e9ception de celle-ci.<\/p>\n<p>Chaque produit\/\u0153uvre \u00e9tant unique ou r\u00e9alis\u00e9 en tirage limit\u00e9, la vente est toujours conclue sous la condition suspensive de sa disponibilit\u00e9.<\/p>\n<p>Toute commande vaut acceptation des prix et des descriptions des produits disponibles \u00e0 la vente au moment de la commande. Aussi, le Client d\u00e9clare avoir pris connaissance et accept\u00e9 irr\u00e9vocablement les pr\u00e9sentes conditions g\u00e9n\u00e9rales de vente avant la passation de sa commande.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 4 : Prix<\/span><\/h3>\n<p>Les prix de vente, conform\u00e9ment \u00e0 l\u2019article L.113-13 du Code de la consommation, sont indiqu\u00e9s, pour chacun des produits figurant sur le site, en euros toutes taxes comprises, hors frais de livraison et de transport mentionn\u00e9s avant validation de la commande et factur\u00e9s en suppl\u00e9ment.<\/p>\n<p>Le prix de vente du Produit\/oeuvre est celui en vigueur au jour de la commande.<\/p>\n<p>Le prix d\u2019un produit\/\u0153uvre peut \u00eatre modifi\u00e9 \u00e0 tout moment, \u00e0 la hausse ou \u00e0 la baisse.<\/p>\n<p>Les prix s\u2019entendent nets, la facturation s\u2019effectue en franchise de TVA conform\u00e9ment \u00e0 la l\u00e9gislation fiscale applicable au r\u00e9gime de la micro-entreprise (article 293B du Code G\u00e9n\u00e9ral des Imp\u00f4ts).<\/p>\n<p>Le paiement de la totalit\u00e9 du prix doit \u00eatre r\u00e9alis\u00e9 lors de la commande. Pour un paiement en plusieurs fois, les sommes vers\u00e9es seront consid\u00e9r\u00e9es comme des arrhes et seront non remboursables.<\/p>\n<p>En cas de livraison dans un pays autre que la France, ses Collectivit\u00e9s d\u2019outre-mer ou ext\u00e9rieur \u00e0 l\u2019Union europ\u00e9enne, si des droits de douane, des taxes locales ou droits d\u2019importation sont exigibles, ces droits sont \u00e0 la charge du Client et rel\u00e8vent de son enti\u00e8re responsabilit\u00e9, tant en termes de d\u00e9clarations que de paiements aux autorit\u00e9s et\/organismes comp\u00e9tents. Il lui appartient de se renseigner aupr\u00e8s des autorit\u00e9s comp\u00e9tentes.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 5 : Paiement<\/span><\/h3>\n<p>Le paiement s\u2019effectue imm\u00e9diatement \u00e0 la commande par l\u2019un des modes de r\u00e8glements suivant :<\/p>\n<ul>\n<li>par paypal et\/ou carte bancaire directement sur le site (payement s\u00e9curis\u00e9),<\/li>\n<\/ul>\n<ul>\n<li>par ch\u00e8que \u00e0 l\u2019ordre de \u00ab Madame Marie Poisson \u00bb et post\u00e9 \u00e0 \u00ab Marie Poisson, 7 rue de la poste, 85190 Beaulieu sous la roche \u2013 France \u00bb en pr\u00e9cisant votre nom, pr\u00e9nom, adresse de livraison et num\u00e9ro de votre commande. La mise \u00e0 l\u2019encaissement sera effectu\u00e9e \u00e0 r\u00e9ception du ch\u00e8que. Le client dispose de 8 jours suite \u00e0 sa commande pour transmettre le ch\u00e8que \u00e0 l\u2019Artiste. Au-del\u00e0 de ces 8 jours, la commande sera automatiquement annul\u00e9e. Seuls les ch\u00e8ques d\u2019une banque fran\u00e7aise sont accept\u00e9s.<\/li>\n<li>Par virement bancaire sur le compte bancaire de Madame Marie Poisson, dont les coordonn\u00e9es bancaires seront fournies sur demande.<\/li>\n<\/ul>\n<p>Un paiement en 4 fois via paypal est propos\u00e9 au client si n\u00e9cessaire. Un \u00e9ch\u00e9ancier de paiement peut aussi \u00eatre mis en place en en faisant la demande \u00e0 l&rsquo;artiste par email \u00e0 mewiefish(at)gmail.com. Les paiement seront effectu\u00e9s tous les 30 jours \u00e0 partir de la date de la premi\u00e8re demande de paiement jusqu&rsquo;\u00e0 payer la totalit\u00e9 de la somme d\u00fbe. Les rappels de calendrier pour le paiement des sommes sont \u00e0 la charge du client. L&rsquo;artiste pourra n\u00e9anmoins envoyer un rappel au client en cas d&rsquo;oubli.<\/p>\n<p>Dans le cas d&rsquo;un paiement en plusieurs fois, les r\u00e8glements sont d\u00fbs aux dates indiqu\u00e9es par l&rsquo;artiste ; g\u00e9n\u00e9ralement tous les trente (30) jours. En cas de d\u00e9faut de paiement du solde dans la limite du d\u00e9lai imparti, l&rsquo;artiste se r\u00e9serve le droit d&rsquo;annuler la commande et de remettre en vente le produit\/oeuvre command\u00e9 par le client. Dans le cas d&rsquo;une telle annulation de r\u00e9servation par d\u00e9faut de paiement, les sommes d\u00e9j\u00e0 vers\u00e9es par le client ne feront l&rsquo;objet d&rsquo;aucun remboursement par l&rsquo;artiste. Dans le cas d&rsquo;une telle annulation de r\u00e9servation par d\u00e9faut de paiement, l&rsquo;artiste se r\u00e9serve le droit de refuser au client l&rsquo;acc\u00e8s \u00e0 l&rsquo;option \u00ab Paiement en plusieurs fois \u00bb pour toute commande ult\u00e9rieure.<\/p>\n<p>&nbsp;<\/p>\n<p>L\u2019exp\u00e9dition de la commande n\u2019a lieu qu\u2019apr\u00e8s r\u00e9ception du\/des paiement(s).<\/p>\n<p>Les paiements par carte bancaire sont d\u00e9bit\u00e9s au moment de la commande. En cas d\u2019indisponibilit\u00e9 de certains des produits command\u00e9s, le consommateur se verra rembourser les sommes d\u00e9bit\u00e9es relatives aux produits indisponibles.<\/p>\n<p>Les paiements effectu\u00e9s par le Client ne seront consid\u00e9r\u00e9s comme d\u00e9finitifs qu\u2019apr\u00e8s encaissement effectif des sommes dues par l\u2019Artiste.<\/p>\n<p>L\u2019Artiste se r\u00e9serve le droit de suspendre toute gestion de commande et toute livraison en cas de refus d\u2019autorisation de paiement par carte bancaire de la part des organismes officiellement accr\u00e9dit\u00e9s ou en cas de non-paiement.<\/p>\n<p>L\u2019Artiste se r\u00e9serve le droit de refuser d\u2019effectuer une livraison ou d\u2019honorer une commande \u00e9manant d\u2019un Client avec lequel un diff\u00e9rend de paiement concernant une commande pr\u00e9c\u00e9dente serait en cours d\u2019administration.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 6 : Livraison<\/span><\/h3>\n<p>Les frais de livraison sont \u00e0 la charge du client. Ils sont calcul\u00e9s une fois la commande pass\u00e9e pour garantir le meilleur rapport qualit\u00e9\/prix en fonction de sa commande. Le total lui sera communiqu\u00e9 une fois le produit\/oeuvre pr\u00eat \u00e0 \u00eatre envoy\u00e9.<\/p>\n<p>Les produits\/oeuvres sont livr\u00e9s \u00e0 l\u2019adresse de livraison que le client a indiqu\u00e9e au cours du processus de commande.<\/p>\n<p>CreaturesDolls livre dans le monde entier.<\/p>\n<p>Le d\u00e9lai de livraison indiqu\u00e9 lors de l\u2019enregistrement de la commande n\u2019est donn\u00e9 qu\u2019\u00e0 titre indicatif et n\u2019est aucunement garanti. L&rsquo;artiste met tout en oeuvre pour proposer une livraison dans les meilleurs d\u00e9lais. Cependant, un retard dans l&rsquo;envoi d&rsquo;un produit\/oeuvre ne peut \u00eatre invoqu\u00e9 par le client pour demander la r\u00e9siliation du contrat, demander des dommages et int\u00e9r\u00eats ou faire valoir tout autre revendication.<\/p>\n<p>Les d\u00e9placements \u00e0 la Poste pour les envois sont effectu\u00e9s par l&rsquo;artiste une fois par semaine dans un souci de praticit\u00e9.<\/p>\n<p>En cas de produits achet\u00e9s en pr\u00e9-commande, le d\u00e9lai de livraison maximal est de quarante jours \u00e0 compter de la date de r\u00e9ception par l&rsquo;artiste des produits command\u00e9s \u00e0 son fournisseur. Le d\u00e9lai peut \u00eatre allong\u00e9 en cas de service pris en extra (make up, v\u00eatements etc). Dans cette situation, l&rsquo;artiste tiendra r\u00e9guli\u00e8rement au courant par email le client de l&rsquo;avanc\u00e9e de sa commande.<\/p>\n<p>Le mode d\u2019exp\u00e9dition standard est le Colissimo suivi avec assurance ad valorem pour la FRANCE m\u00e9tropolitaine (2 \u00e0 4 jours ouvrables) et le Colissimo international avec d\u00e9claration de valeur et assurance ad valorem (4 \u00e0 8 jours ouvrables). Les d\u00e9lais de livraison peuvent varier en fonction de la zone g\u00e9ographique du Client. Les frais d\u2019exp\u00e9dition comprennent l\u2019emballage, la manutention et les frais postaux. Les \u0153uvres sont emball\u00e9es avec soin avant d\u2019\u00eatre transmise au transporteur.<\/p>\n<p>Toute anomalie concernant un produit\/oeuvre (article manquant, cass\u00e9 etc&#8230;) devra \u00eatre report\u00e9 \u00e0 l&rsquo;attention de l&rsquo;artiste \u00e0 r\u00e9ception du colis dans les trois (3) jours suivant la livraison du produit\/oeuvre via cette adresse mail : mewiefish(at)gmail.com.<\/p>\n<p>Aucune responsabilit\u00e9 ne pourra \u00eatre retenue \u00e0 l&rsquo;\u00e9gard de l&rsquo;artiste en cas de probl\u00e8mes de livraison d\u00fbs \u00e0 des mentions erron\u00e9es ou incompl\u00e8tes de la part du client, ou \u00e0 cause des services de La Poste.<\/p>\n<p>Dans le cas o\u00f9 la livraison est impossible suite \u00e0 une erreur sur l\u2019adresse indiqu\u00e9e par le Client, l\u2019Artiste contacte le Client le plus rapidement possible afin d\u2019obtenir une nouvelle adresse de livraison auquel cas les \u00e9ventuels frais de livraison suppl\u00e9mentaires sont \u00e0 la charge du Client.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #5fc2ae;\">Article 7 : garanties et reponsabilit\u00e9s<\/span><\/h3>\n<p>L&rsquo;artiste r\u00e9pond des d\u00e9fauts de conformit\u00e9 existant lors de la d\u00e9livrance du produit. Elle r\u00e9pond \u00e9galement des d\u00e9fauts de conformit\u00e9 r\u00e9sultant de l&#8217;emballage.<\/p>\n<p>En cas de livraison d&rsquo;un produit non-conforme ou en cas de livraison d&rsquo;un produit r\u00e9v\u00e9lant un vice cach\u00e9, l&rsquo;artiste s&rsquo;engage soit \u00e0 rembourser le client du prix du produit, soit \u00e0 \u00e9changer le produit pour un autre identique en fonction des stocks disponibles, soit \u00e0 lui \u00e9changer pour un produit de qualit\u00e9 et de prix \u00e9quivalent en fonction des stocks disponibles.<\/p>\n<p>L&rsquo;action r\u00e9sultant du d\u00e9faut de conformit\u00e9 se prescrit par un an \u00e0 compter de la d\u00e9livrance du bien.<br \/>\nCes dispositions ne sont pas exclusives du droit de r\u00e9traction d\u00e9fini \u00e0 l&rsquo;article 8.<\/p>\n<p>Sont exclus de garantie les produits modifi\u00e9s, r\u00e9par\u00e9s, int\u00e9gr\u00e9s ou ajout\u00e9s par le client ou toute autre personne non autoris\u00e9e par le fournisseur dudit produit.<br \/>\nLa garantie ne jouera pas pour les vices apparents.<br \/>\nLa garantie ne prendra pas en charge les produits ou services endommag\u00e9s lors du transport ou d&rsquo;une mauvaise utilisation.<\/p>\n<p>L&rsquo;artiste rappelle que les produits propos\u00e9s sur le site www.creaturesdolls.com, objets d\u00e9coratifs de collection, n&rsquo;entrent pas dans la cat\u00e9gorie des jouets et ne sont pas destin\u00e9s \u00e0 un usage par des enfants ou des mineurs.
