C&rsquo;est une poup\u00e9e destin\u00e9e aux adultes et collectionneurs (ce n&rsquo;est pas un jouet pour les enfants). La plupart du temps elle est en r\u00e9sine, mais elle peut aussi \u00eatre en porcelaine ou dans d&rsquo;autres mati\u00e8res (p\u00e2tes polym\u00e8res etc). Elle existe sous plein de formes diff\u00e9rentes, humaine (femme, homme, enfant) ou fantastique (centaures, animaux etc).<\/p>\n<p>Les BJD existent en plusieurs tailles qui varient de moins de 10\u00a0cm \u00e0 plus de 80\u00a0cm.<\/p>\n<ul>\n<li>Taille\u00a0<b>Super Dollfie<\/b>\u00a0(SD)\u00a0: Environ 60\u00a0cm, \u00e0 l\u2019\u00e9chelle 1\/3.<\/li>\n<li>Taille\u00a0<b>Mini Super Dollfie<\/b>\u00a0(MSD)\u00a0: Environ 42\u00a0cm, \u00e0 l\u2019\u00e9chelle 1\/4.<\/li>\n<li>Taille\u00a0<b>Yo Super Dollfie<\/b>\u00a0(YoSD)\u00a0: Environ 27\u00a0cm, \u00e0 l\u2019\u00e9chelle 1\/6.<\/li>\n<li><b>Tiny<\/b>\u00a0: Environ 16\u00a0cm, \u00e0 l\u2019\u00e9chelle 1\/12.<\/li>\n<\/ul>\n<p>Ce qui fait le charme des BJD c&rsquo;est qu&rsquo;elles sont customisables (personnalisables) \u00e0 volont\u00e9 : on peut changer les cheveux, les yeux, les v\u00eatements, le maquillage ou l&rsquo;apparence et parfois les mains et pieds. Elles sont aussi enti\u00e8rement articul\u00e9es, on peut donc les manipuler facilement et leur faire prendre la pose.<\/p>\n<p>Les BJD sont un support artistique tr\u00e8s riche qui permet de nombreuse activit\u00e9s : couture, maquillage, dessin, photographie, mise en sc\u00e8ne, tricot, fabrication de d\u00e9cors, peinture, fabrication de perruques\/accessoires&#8230; Elles sont souvent consid\u00e9r\u00e9es comme des oeuvres \u00e0 part enti\u00e8res et se voient fr\u00e9quemment expos\u00e9es en vitrine.<\/p>\n<p>Un article tr\u00e8s complet <a href=\"https:\/\/www.lesitedespoupees.com\/les-poupees-bjd\/\">\u00e0 consulter ici<\/a> pour plus d&rsquo;infos, ou simplement sur <a href=\"https:\/\/fr.wikipedia.org\/wiki\/Poup%C3%A9e_articul%C3%A9e\">wikipedia<\/a>.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00a0\u00bbO\u00f9 as-tu appris \u00e0 faire des BJD ?\u00a0\u00bb tab_id=\u00a0\u00bb6a5c5173-d826-9&Prime;][vc_column_text]Je suis totalement autodidacte en ce qui concerne le modelage et la sculpture.<\/p>\n<p>J\u2019aime dessiner depuis toujours ; j\u2019ai suivi une formation de 2 ans aux m\u00e9tiers de l\u2019image, ce qui m\u2019a permis de d\u00e9velopper un certain sens graphique et de pouvoir retranscrire sur papier ce que j\u2019ai dans la t\u00eate (\u00e0 peu pr\u00e8s !). Pour les BJDs, j\u2019ai beaucoup fouill\u00e9 sur internet pour trouver des tutoriels, j\u2019ai beaucoup observ\u00e9, je me suis beaucoup entra\u00een\u00e9e et je me suis bien \u00e9quip\u00e9e en mat\u00e9riel pour travailler dans de relatives bonnes conditions (masque pour la poussi\u00e8re\/\u00e9manations toxiques, dremel, scalpels, p\u00e2tes sp\u00e9cifiques etc). Le fait d&rsquo;avoir aussi des BJDs \u00e0 la maison m&rsquo;a fait mieux comprendre leur fonctionnement sachant que toutes les marques de BJDs ont leurs propres fa\u00e7ons de cr\u00e9er leurs poup\u00e9es.<\/p>\n<p>Je continue bien s\u00fbr toujours de d\u00e9couvrir de nouvelles choses, de glaner des conseils ici et l\u00e0, de m\u2019entra\u00eener\u2026 Il n&rsquo;y a pas de secret, le plus important est la pratique : plus on pratique et plus on progresse ![\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00a0\u00bbComment sont cr\u00e9\u00e9es les BJD de chez Creatures Dolls ?\u00a0\u00bb tab_id=\u00a0\u00bb316cb1da-ab8b-2&Prime;][vc_column_text]Je cr\u00e9e tous mes mod\u00e8les chez moi dans mon atelier.<\/p>\n<p>Je commence souvent par dessiner des id\u00e9es sur papier, puis quand le dessin est assez pr\u00e9cis je passe au modelage. En g\u00e9n\u00e9ral, je commence par un dessin taille r\u00e9elle de face et profil, puis je r\u00e9alise une armature en polystyr\u00e8ne qui sera recouverte de p\u00e2te Ladoll (sorte de papier m\u00e2ch\u00e9+argile) qui s\u00e8che \u00e0 l&rsquo;air. Je sculpte et mod\u00e8le jusqu&rsquo;\u00e0 obtenir le r\u00e9sultat qui me plait puis je d\u00e9coupe tous les endroits o\u00f9 il y aura des articulations (apr\u00e8s les avoir vid\u00e9es du polystyr\u00e8ne) : c&rsquo;est la partie la plus technique et la plus longue car c&rsquo;est celle qui n\u00e9cessite le plus d&rsquo;ajustements pour une bonne posabilit\u00e9 de la poup\u00e9e. Une fois la poup\u00e9e compl\u00e8te, il faut poncer chacune des pi\u00e8ces tr\u00e8s soigneusement, puis les passer \u00e0 l&rsquo;appr\u00eat en bombe pour imperm\u00e9abiliser la surface (il faut passer plusieurs couches et poncer finement entre chaque !).<\/p>\n<p>Je travaille aussi avec des parties pr\u00e9 existantes de mes cr\u00e9ations afin de gagner du temps lorsque mon nouveau projet ne n\u00e9cessite pas de cr\u00e9er une nouvelle doll de A \u00e0 Z ; par exemple si je souhaite cr\u00e9er un nouveau buste\/t\u00eate ou un mod\u00e8le similaire, je travaillerai \u00e0 partir des pi\u00e8ces d\u00e9j\u00e0 cr\u00e9\u00e9es en les modifiants avec des p\u00e2tes epoxy.<\/p>\n<p>Ensuite la poup\u00e9e est pr\u00eate \u00e0 \u00eatre moul\u00e9e avec du silicone, puis reproduite en r\u00e9sine. Les tirages qu\u2019ils proposent sont de tr\u00e8s bonne qualit\u00e9. Ce mode de fonctionnement me permet de proposer des prix plus bas qu\u2019un tirage d\u2019artiste et me fait gagner du temps pour la partie cr\u00e9ation et le reste de mon activit\u00e9.<\/p>\n<p>Je ne propose actuellement plus de tirages maison pour les bjd car je ne souhaite plus \u00eatre en contact avec certaines mati\u00e8res toxiques tant que je n\u2019ai pas un endroit d\u00e9di\u00e9 uniquement \u00e0 cette activit\u00e9. Il m&rsquo;arrive d&rsquo;en faire mais pour des choses sp\u00e9cifiques et en petits tirages (cr\u00e9atures non articul\u00e9es).[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab title=\u00a0\u00bbCombien de temps faut-il pour faire une BJD ?\u00a0\u00bb tab_id=\u00a0\u00bb1585648439582-7-0&Prime;][vc_column_text]Cela est assez variable. Pour une cr\u00e9ature unique, cela peut prendre quelques heures comme quelques jours, voire plusieurs semaines : entre la conception, le modelage, la peinture, le conditionnement, pour certaines le temps de s\u00e9chage, cela peut \u00eatre long. Cela d\u00e9pend aussi de la taille, du niveau de d\u00e9tails que l\u2019on veut, des finitions\u2026<\/p>\n<p>Pour une bjd, il faut plus de temps, sachant qu&rsquo;entre une poup\u00e9e de 15cm et une de 60cm, le temps pass\u00e9 ne sera pas le m\u00eame&#8230; Par exemple, avant de pouvoir passer au moulage, le mod\u00e8le Bactro m\u2019a demand\u00e9 du travail sur un an. Il faut concevoir le mod\u00e8le, le r\u00e9aliser, le passer \u00e0 l\u2019appr\u00eat puis le poncer. Si on souhaite tout faire maison, il faut \u00e9galement faire les moules, puis les tirages r\u00e9sine, qu\u2019il faut ensuite nettoyer, poncer, percer, assembler puis customiser avec plusieurs couches de vernis, faire les finition puis conditionner le tout dans une bo\u00eete (elle aussi customis\u00e9e au pr\u00e9alable).<\/p>\n<p>C&rsquo;est r\u00e9ellement un travail \u00e0 plein temps qui n\u00e9cessite un investissement total ! (je laisse en g\u00e9n\u00e9ral entre 2 \u00e0 3 semaines pour passer commande)<\/p>\n<p>Il est donc possible de r\u00e9server sa poup\u00e9e en remplissant un bon de commande disponible au moment de la pr\u00e9 commande. Vous payez d&rsquo;avance le montant de la poup\u00e9e, en une ou plusieurs fois, puis d\u00e8s que la poup\u00e9e est disponible et enti\u00e8rement pay\u00e9e, elle vous est envoy\u00e9e. Il peut s\u2019agir d\u2019une marque, d\u2019un mod\u00e8le, d\u2019un brevet, d\u2019un droit d\u2019auteur, d\u2019un logiciel, d\u2019un circuit int\u00e9gr\u00e9 ou d\u2019une obtention v\u00e9g\u00e9tale.<\/p>\n<p>Plus pr\u00e9cis\u00e9ment, l\u2019INSEE d\u00e9finit la pratique comme \u00ab\u2009<em>la reproduction, l\u2019imitation ou l\u2019utilisation totale ou partielle d\u2019une marque, d\u2019un dessin, d\u2019un brevet, d\u2019un logiciel ou d\u2019un droit d\u2019auteur, sans l\u2019autorisation de son titulaire, en affirmant ou laissant pr\u00e9sumer que la copie est authentique<\/em><em>\u00a0<\/em>\u00bb.<\/p>\n<p>Ainsi, le contrefacteur va cr\u00e9er une <strong>confusion<\/strong> entre le produit original et le produit contrefaisant de sorte qu\u2019il cherche \u00e0 <strong>s\u2019approprier la notori\u00e9t\u00e9 d\u2019une autre entreprise<\/strong> ou d\u2019une marque et \u00e0 <strong>profiter des investissements<\/strong> du titulaire du droit de propri\u00e9t\u00e9 intellectuelle <strong>sans son autorisation<\/strong>.<\/p>\n<p>Le code de la propri\u00e9t\u00e9 intellectuelle la d\u00e9finit aux articles L. 335-2 et suivants comme la reproduction, l\u2019usage, l\u2019apposition ou l\u2019imitation d\u2019une marque ; toute copie, importation ou vente d\u2019une invention nouvelle ; toute reproduction totale ou partielle d\u2019un dessin ou mod\u00e8le ; toute \u00e9dition d\u2019\u00e9crits, de compositions musicales, de production imprim\u00e9e ainsi que toute reproduction, repr\u00e9sentation ou diffusion d\u2019une \u0153uvre de l\u2019esprit en violation des droits d\u2019auteur, etc. Ainsi, il existe plusieurs d\u00e9finitions de la contrefa\u00e7on suivant le droit de propri\u00e9t\u00e9 intellectuelle qu\u2019elle atteint.<\/p>\n<p>Dans tous les cas,<strong> le r\u00f4le de la propri\u00e9t\u00e9 intellectuelle demeure celui d\u2019interdire la contrefa\u00e7on<\/strong>. C\u2019est l\u2019id\u00e9e de la protection par le droit de propri\u00e9t\u00e9 intellectuelle d\u2019un monopole : tout acte fait en dehors de ce monopole constitue une contrefa\u00e7on.<\/p>\n<p>&nbsp;<\/p>\n<h3>Les sanctions p\u00e9nales<\/h3>\n<ul>\n<li><strong>3 ans d\u2019emprisonnement et de 300 000 euros d\u2019amende<\/strong> \u00e0 l\u2019encontre des personnes physiques, qu\u2019il s\u2019agisse de la contrefa\u00e7on de propri\u00e9t\u00e9 litt\u00e9raire ou artistique (article L. 335-2 et s. CPI), de dessins et mod\u00e8les (article L. 521-2 et s. CPI) ou de brevet d\u2019invention (article L. 615-14 et s. CPI), les peines sont identiques. Lorsque l\u2019infraction est commise en bande organis\u00e9e, les peines sont port\u00e9es \u00e0 cinq ans d\u2019emprisonnement et 500 000 euros d\u2019amende. En cas de r\u00e9cidive, les peines sont port\u00e9es au double.<\/li>\n<li><strong>Poss\u00e9der un objet de contrefa\u00e7on constitue un acte de recel<\/strong>. En effet, le recel est le fait de dissimuler, d\u00e9tenir, transmettre, ou faire office d\u2019interm\u00e9diaire afin de transmettre une chose dont on sait qu\u2019elle provient d\u2019un crime ou d\u2019un d\u00e9lit (article 321-1 al 1 du Code p\u00e9nal). L\u2019infraction r\u00e9side aussi dans le fait de b\u00e9n\u00e9ficier, en connaissance de cause et par tout moyen, du produit d\u2019un crime ou d\u2019un d\u00e9lit (article 321-1 al 2 du Code p\u00e9nal). Il ne suffit pas que la personne invoque son ignorance de l\u2019origine de la chose pour que sa bonne foi soit reconnue.<\/li>\n<li><strong>Le receleur encourt les peines de 5 ans d\u2019emprisonnement et 375 000 euros d\u2019amende<\/strong> (article 321-1 du Code p\u00e9nal) mais les peines peuvent \u00eatre aggrav\u00e9es en raison du recel lui-m\u00eame, notamment s\u2019il est habituel, li\u00e9 aux facilit\u00e9s procur\u00e9es par l\u2019exercice d\u2019une activit\u00e9 professionnelle ou commise en bande organis\u00e9e ainsi qu\u2019en raison de l\u2019infraction d\u2019origine qui peut \u00eatre r\u00e9prim\u00e9e plus s\u00e9v\u00e8rement que le recel simple.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Les contrefacteurs exploitent les vides juridiques et les failles administratives partout o\u00f9 ils existent.<\/p>\n<p>La contrefa\u00e7on fausse le jeu de la concurrence honn\u00eate et entra\u00eene de lourdes pertes de recettes : pour nous qui travaillons \u00e0 notre compte, cela peut \u00eatre dramatique car nous pouvons perdre notre travail \u00e0 long terme. Le souci est aussi que les lois sur la contrefa\u00e7on ne sont pas les m\u00eames partout dans le monde&#8230;<\/p>\n<p>Selon Interpol, \u00ab la contrefa\u00e7on est une activit\u00e9 criminelle \u00e0 part enti\u00e8re qui n\u2019est pas en p\u00e9riph\u00e9rie des autres activit\u00e9s criminelles, mais au c\u0153ur de celles-ci \u00bb.<\/p>\n<p>&nbsp;<\/p>\n<h3>En conclusion<\/h3>\n<p>En ce qui concerne la poup\u00e9e, le recast ou contrefa\u00e7on est bien consid\u00e9r\u00e9 comme du <strong>vol pur et simple du travail de cr\u00e9ation<\/strong>, les textes sont assez clairs et ne laissent pas de place au d\u00e9bat. Le recast ne peut \u00eatre justifi\u00e9 par aucun motif.<\/p>\n<p>Oui une poup\u00e9e l\u00e9gale sera toujours plus ch\u00e8re qu&rsquo;une poup\u00e9e recast\u00e9e, c&rsquo;est normal : lorsque vous achetez une poup\u00e9e aupr\u00e8s d&rsquo;un(e) cr\u00e9ateur(trice), vous ne payez pas uniquement l&rsquo;objet en lui m\u00eame, vous payez par ce biais le temps pass\u00e9 \u00e0 cr\u00e9er la poup\u00e9e (nous ne sommes pas pay\u00e9s lorsque nous cr\u00e9ons), l&rsquo;expertise et l&rsquo;exp\u00e9rience, un service professionnel, un service apr\u00e8s-vente si besoin ; vous permettez \u00e0 une personne qui travaille \u00e0 son compte de se payer des soins ou \u00e0 prendre un peu de vacances (les ind\u00e9pendants comme moi n&rsquo;ont pas de cong\u00e9s pay\u00e9s, c&rsquo;est une des aberrations de notre statut), de se payer \u00e0 manger, un toit et des v\u00eatements, de pouvoir se donner les moyens de continuer \u00e0 cr\u00e9er. La plupart des personnes travaillant \u00e0 plein temps \u00e0 cr\u00e9er des poup\u00e9es ont des statuts pr\u00e9caires, donc acheter des poup\u00e9es recast\u00e9es ne fera qu&rsquo;accentuer la pr\u00e9carit\u00e9 de nos m\u00e9tiers et sur le long terme r\u00e9duire l&rsquo;offre des choses int\u00e9ressantes propos\u00e9es sur le march\u00e9, voire ne plus avoir de nouveaut\u00e9s du tout. Les recasteurs ne prennent pas le risque de ce temps non r\u00e9mun\u00e9r\u00e9 : ils r\u00e9cup\u00e8rent uniquement le travail d\u00e9j\u00e0 r\u00e9alis\u00e9 pour le reproduire \u00e0 bas prix.
